INVITATION TO APPLY FOR ELIGIBILITY AND TO BID

PNOC Exploration Corporation (PNOC EC), through its 2008 Corporate Budget, intends to apply the sum of Two Million Five Hundred Thousand Pesos (Php2,500,000.00) being the Approved Budget for the Contract (ABC) to payments under the contract for the ENVIRONMENTAL CONSULTANCY SERVICES FOR COAL OPERATING CONTRACT 122 (the “Project”). Bids received in excess of the ABC shall be automatically rejected at the opening of the financial proposals. Eligibility documents may be secured from the Procurement Section (c/o Ms. Iris E. Rivera) starting June 16, 2008 upon presentation of a Letter of Intent and upon payment of a non-refundable fee Two Thousand Five Hundred Pesos (Php2,500.00). Eligibility of prospective consultants shall be based on compliance with the eligibility requirements, using a non-discretionary “pass/fail” criteria, as specified in the Implementing Rules and Regulations Part A (IRR-A) of Republic Act (R.A.) No. 9184 or the Government Procurement Reform Act. The deadline for the submission of Letter of Intent (LOI) from prospective bidders is on or before June 27, 2008at 4:00P.M., while the deadline for the submission of accomplished Eligibility Documents is on or before July 4, 2008at 10:00 A.M. Late submission of eligibility documents shall not be accepted. Only those that are short listed will be entitled to submit bids.

The BAC shall draw up the short list of consultants from those who have submitted LOIs and have been determined as eligible both in accordance with the provision of R.A. 9184 and its IRR-A. The short list of prospective bidders shall consist of 3 to 5 consultants. The criteria and rating system for short listing are:

1. Type and scale of previous and ongoing projects of Consulting Firm - 40%

2. Qualifications of Consultants who may be assigned for the project - 40%

3. Capacity to deliver output relative to current workload - 20%

Bidding will be conducted through open competitive bidding procedures as specified in the IRR-A of R.A. 9184, and is restricted, unless otherwise stated, to Filipino citizens or organizations with at least sixty percent (60%) interest belonging to citizens of the Philippines. In accordance with IRR-A of R.A. 9184, only bids from short listed consultants will be opened. The process for the eligibility check is described in the Eligibility Documents. In accordance with the IRR-A of R.A. No. 9184 the contract will only be awarded to the Highest Rated and Responsive Bidder who was determined as such during post-qualifications.PNOC EC shall evaluate bids using the Quality-Cost Based Evaluation (QCBE) procedure. The criteria and rating system for the evaluation of bids are indicated in the Terms of Reference.

For the purpose of clarifying certain issues, a Pre-Bid Conference will be held on July 14, 2008, 10:00 A.M.at the PNOC EC Head Office, Energy Center, Merritt Road, Fort Bonifacio, Taguig City. Bids (Technical and Financial Proposals) must be submitted in three (3) sets each to PNOC EC’s Bids and Awards Committee at Bldg. 1 Energy Center, Merritt Road, Fort Bonifacio, Taguig City not later than 10:00 A.M.on July 28, 2008. Late Bids shall not be accepted. PNOC EC reserves the right to accept or reject any bid, to annul the bidding process, and to reject all bids at any time prior to contract award, without thereby incurring any liability to the affected bidder or bidders.
